Hunter Biden trial on federal gun charges begins Monday

(NewsNation) – Jury selection is scheduled to begin Monday in federal court in Wilmington, Del., in the federal trial of Hunter Biden, President Joe Biden’s son.

The younger Biden is accused of lying on a federal form when he purchased a .38-caliber Colt Cobra Special in 2018. Biden falsely said he was not a drug user, despite being addicted to cocaine at the time.

“I don’t think he’s going to prison, just like I don’t think Trump is going to prison in his New York case,” the former assistant U.S. attorney said. David Katz.

“That was all a long time ago. It wasn’t violent. The weapon was never used violently or inappropriately. It was thrown away less than two weeks later (after purchase),” Katz told “NewsNation.”

The trial begins nearly a year after U.S. District Court Judge Maryellen Noreika raised concerns about a plea deal that would have spared Hunter Biden any prison time.

Katz believes Hunter Biden will be found guilty since the facts of the course are not in dispute, but he also predicts the defense will argue over the term “addict.”

“He will argue that it is too vague, it is speculative. People don’t define themselves as ‘addicts”.

While the facts may be indisputable, Hunter Biden’s lawyer said we can’t ignore the politics of the case.

“He (Hunter Biden) is being punished for the alleged sins of his father — the sin of opposing Mr. Trump’s election as president,” according to court documents filed by Lowell, who also represented Ivanka Trump and Jared Kushner, the former daughter and son-in-law of the president.

Lead prosecutor David Weiss said “political considerations” played no role in the investigation. He told lawmakers behind closed doors last year that no one at the Justice Department stopped him from pursuing the charges.

Even with a guilty verdict, Katz says Hunter Biden is unlikely to face any prison time because he is a first-time offender, not because he is the son of a sitting president.

Katz also says he wouldn’t be surprised if Joe Biden, if re-elected, pardons his son or commutes his sentence. Katz says Donald Trump would undoubtedly do the same if one of his children were in this position.

Hunter Biden’s legal problems will head west in September. He will face arraignment in Los Angeles on allegations he failed to pay about $1.4 million in federal income taxes.
